As we conclude a turbulent decade in Florida Workers’ Compensation, the pursuit and defense of Fla. Stat. 440.105, the “misrepresentation” defense, has emerged as a preeminent factor in our daily practice. From a Claimant’s perspective, it is more crucial than ever to properly prepare a witness for the rigors of litigation and physician appointments. For Employer/Carriers, a multitude of factors play into the final decision to “claim fraud.” This seminar will discuss in detail the various facets of this defense, with an emphasis on ethical, practical, and economic considerations for both sides in confronting this “all or nothing” issue.
